Terms and Conditions — NØRD Coffee MX
General Information
Welcome to NØRD Coffee MX. The terms "we," "us," and "our" refer to NØRD Coffee. We operate this store and website, including all related information, content, features, tools, products, and services (the "Services"), powered by Shopify.
These Terms and Conditions (the "Terms"), together with our Privacy Policy [LINK], our Shipping Policy [LINK], and our Return and Refund Policy [LINK], describe your rights and responsibilities when using the Services. Please read them carefully, as they include important information about warranties, liability, and your legal rights.
By visiting, browsing, or making a purchase on NØRD Coffee, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Access and Account
By accepting these Terms, you represent that you are at least the legal age of majority in your state or jurisdiction of residence.
To use the Services — including browsing the store or purchasing any product — we may ask you for information such as email, address, and payment and shipping details. You represent that all information you provide is accurate, current, and complete, and that you have the necessary rights to provide it.
You are solely responsible for maintaining the security of your account and for all activity that occurs under it. You may not transfer, sell, or assign your account to another person.
2. Our Products
NØRD Coffee sells home-roasted Mexican specialty coffee, under two lines:
- Regular line — continuously available.
- Micro-lots — limited quantities per harvest, available through drops. Once a lot sells out, it is not restocked; the next lot will be different.
Coffee is a perishable product. We do our best to display products accurately in the store; however, actual color, packaging, or appearance may vary slightly from what is shown on screen, depending on your device and its settings. We do not guarantee that the product's appearance will be identical to what is displayed.
Product descriptions may be modified at any time without prior notice. We reserve the right to discontinue any product or limit available quantities, per person, region, or harvest reason.
3. Pricing and Billing
All prices are shown in Mexican pesos (MXN). Unless otherwise indicated, posted prices include applicable taxes and do not include shipping costs, which are calculated separately at checkout.
Prices may change without prior notice. The applicable price will be the one in effect at the time your purchase is confirmed, as reflected in your order confirmation.
You agree to provide truthful, complete, and current payment and billing information, and to keep it up to date so that we can process your purchase and contact you if necessary. You represent that you are duly authorized to use the payment method you provide.
4. Payment Methods
You may pay through the following platforms: Shopify Payments, Stripe, PayPal, SPEI, and/or other platforms available at checkout.
NØRD Coffee does not store sensitive banking information. Payment processing is carried out directly through those platforms, subject to their own terms and privacy policies.
5. Orders and Confirmation
By placing an order, you are making an offer to purchase. An order is considered confirmed only once payment has been approved and validated. We reserve the right to accept, reject, or cancel any order, including in cases of fraud, payment errors, inconsistencies in information, or lot unavailability.
Review your order carefully before completing your purchase: once accepted, we may not be able to process cancellation requests. If we do not accept, or if we modify or cancel an order, we will attempt to notify you by email or through the contact information provided.
Your purchase must be for personal or household use, not for resale or commercial export.
6. Shipping and Delivery
Specific shipping times, costs, and conditions are governed by our Shipping Policy, which forms an integral part of these Terms.
- CDMX and metropolitan area: local delivery via courier service.
- National shipping: via ground or express carrier.
All delivery times are estimated and not guaranteed. We are not responsible for delays caused by the shipping company, external procedures, or events beyond our control. Once the product is transferred to the shipping company, the risk of loss or damage transfers to you.
7. Exchanges, Returns, and Refunds
As this is a perishable product, returns and refunds are limited to the cases expressly set out in our Return and Refund Policy, which forms an integral part of these Terms. Review your order carefully before confirming it: due to the nature of the product, not all purchases are eligible for return.
8. Cancellations
Cancellations may only be requested before the order has been processed, roasted, or shipped. Once the roasting, packaging, or shipping process has begun, the order cannot be canceled.
9. Intellectual Property
NØRD Coffee, the isotype, the name, the tagline "Find your NØRD.," the designs, text, images, photographs, product content, and the overall design of the Services are the property of NØRD Coffee and are protected by applicable intellectual property laws.
These Terms allow you to use the Services solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, display, republish, download, or transmit any material from the Services without our prior written consent.
The Shopify name, logo, and trademarks are the property of Shopify. All other trademarks referenced in the Services belong to their respective owners.
10. Feedback and User Content
If you send us ideas, suggestions, reviews, or any other type of feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such Feedback for any purpose, including commercial purposes.
You represent that you hold all necessary rights to your Feedback, that it does not infringe on third-party rights, and that it does not contain illegal, defamatory, obscene, or malicious content. We have no obligation to keep your Feedback confidential, to compensate you for it, or to respond to it.
We may, without obligation to do so, monitor, edit, or remove any Feedback we consider inappropriate or in violation of these Terms.
11. Optional Third-Party Tools
We may provide you access to third-party tools integrated into the Services, over which we have no control or oversight. Your use of such tools is at your own risk and discretion, subject to the relevant provider's terms. We assume no liability arising from your use of such tools.
12. Third-Party Links
The Services may include links to third-party sites. We are not responsible for the content, accuracy, or practices of such sites. Accessing them is at your own risk.
13. Privacy
All personal information we collect is subject to our Privacy Policy. Because the Services are hosted on Shopify, certain information may also be processed in accordance with Shopify's Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy.
15. Prohibited Uses
You may access and use the Services solely for lawful purposes. You may not use the Services to:
- Engage in any illegal, fraudulent, or malicious purpose, including placing false orders or orders with incorrect information
- Infringe upon your own or third parties' intellectual property rights
- Harass, defame, or harm any person
- Transmit false or misleading information
- Send unsolicited mail, viruses, or malicious code
- Impersonate another person or entity
- Interfere with the security or operation of the site
- Collect personal information about other users
- Reproduce, extract, or commercially exploit any part of the Services without authorization
We reserve the right to suspend or terminate the access of any user who violates these Terms, without prior notice.
16. AI Agents and Automation
This section applies if you use, allow, or cause an Agent (any software that acts autonomously or semi-autonomously on your behalf, including agentic artificial intelligence tools) to access or interact with the Services.
No Agent may access, use, or interact with the Services unless it clearly identifies itself as such at all times. Agents must:
- Identify themselves in every request, including "Agent/[agent name]" in the request's user-agent
- Not conceal or create confusion about the fact that the interaction originates from an Agent
- Not imitate human behavior or bypass CAPTCHAs or other verification measures
- Respond truthfully if asked whether the interaction originates from a human or an automated system
- Not circumvent measures intended to block, limit, or control Agent access
We may limit, through technical measures, the access of any Agent to the Services.
17. Errors, Inaccuracies, and Omissions
Occasionally there may be typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping costs, or availability. We reserve the right to correct such errors and to update or cancel affected orders at any time, even after an order has been placed.
18. Termination
We may terminate this agreement or your access to the Services at any time and at our sole discretion, without prior notice. You will remain responsible for any amounts owed up to the date of termination.
The sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and any other provision that by its nature should survive, will continue to apply after termination.
19. Disclaimer of Warranties
The information presented in the Services is provided for general informational purposes only. We do not guarantee its accuracy, completeness, or usefulness. Any reliance you place on such information is at your own risk.
UNLESS EXPRESSLY STATED, THE SERVICES AND THE PRODUCTS OFFERED ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THIS LIMITATION, SO IT MAY NOT APPLY TO YOU.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NØRD COFFEE, ITS COLLABORATORS, AFFILIATES, AGENTS, OR SERVICE PROVIDERS — INCLUDING SHOPIFY AND ITS AFFILIATES — WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY THEREOF.
21. Indemnification
You agree to indemnify, defend, and hold harmless NØRD Coffee, Shopify, and our respective affiliates, collaborators, and providers, against any third-party claim — including legal fees — arising from: (1) your breach of these Terms; (2) your violation of any law or third-party right; or (3) your access to and use of the Services.
22. Severability
If any provision of these Terms is determined to be illegal, void, or unenforceable, that provision will be deemed severed without affecting the validity and enforceability of the remaining provisions.
23. Waiver and Entire Agreement
Our failure to exercise any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with the referenced policies, constitute the entire agreement between you and NØRD Coffee regarding use of the Services, and supersede any prior agreement or communication, whether oral or written.
24. Assignment
You may not transfer, assign, or delegate your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms without your consent.
25. Governing Law
These Terms are governed by and construed in accordance with the applicable laws of the United Mexican States. Any dispute related to these Terms will be submitted to the competent courts of Mexico City.
26. Changes to These Terms
We may update, change, or replace any part of these Terms at any time by posting the updated version on this page. We will notify you of material changes when required by law. Your continued use of the Services after a change is posted constitutes your acceptance of that change.
